PERSONAL DATA PROCESSING NOTICE
(Art. 13 of EU Regulation 2016/679)

As of 09/08/2022, we have deactivated the Google Analytics v.3 service for tracking visits and we have activated the new Google Analytics v.4 service, which is in compliance with the privacy standards required by current regulations.

Pursuant to Article 13 of the EU Regulation 2016/679 (hereinafter referred to as the GDPR) concerning the
protection of personal data, you are advised that the personal data collected in relation to the contractual
relationships established or merely to enquiries will be processed in compliance with the aforesaid regulations and
you are likewise advised as follows.

PERSONAL DATA COLLECTED
The personal data collected, with your free and express consent, comprises exclusively:
– identification data (e.g. first name, surname, address, telephone, fax, email, …)
– tax details (where required by law, e.g. tax identification number, VAT, …)

PERSONAL DATA CONTROLLER AND PROCESSOR (13.1 a, b)
The Data Controller in relation to your personal data is CERAMICA FONDOVALLE S.P.A, based at Via Rio
Piodo, n. 12 – TORRE MAINA, MARANELLO, 41053 (MO). The role of Data Processor has been assigned to
ILARIA PATRI, whom the Data Subject can contact via email at the following address: privacy@gruppoitalcer.it
or via telephone at the following number: +39 0522 625368 in order to exercise the rights envisaged in Art. 13.2
subsections b, c, and d.

PERSONAL DATA PROCESSING PURPOSE AND PROCEDURE (13.1 c)
Your personal data is processed for the following purposes:
1) to meet legal requirements connected to the contractual relationship;
2) to handle the contractual relationship on an organisational level;
3) to respond to the request received.
Your personal data and the photos/videos will be processed in paper, digital, and online form and will be entered in
the pertinent databases, which may be accessed exclusively by the Data Controller and those tasked thereby. With
regards to data processed electronically, it is stressed that all the appropriate security measures have been taken to
protect the data subject’s rights, freedom, and legitimate interests, as per Art. 22, paragraph 3, of the GDPR.

POSSIBLE RECIPIENTS OF PERSONAL DATA (13.1 e, f)
In relation to the purposes specified in sections 1, 2, and 3 of the previous section, the data may be disclosed to the
parties or categories of parties stated below:
– Recognised accountancy firms in relation to the provision of assistance to companies when the disclosure is
required by law or is in the interest of the party (natural or legal person);
– Recognised legal firms in relation to the provision of assistance to companies when the disclosure is required by
law and when such firms are duly assigned to carry out this form of processing in full compliance with measures in
force, or when the disclosure is in the party’s interest.
The Data Controller also hereby informs you that it does not intend to transfer your data to a non-EU third-country
or to any international organisation outside the EU.

PERSONAL DATA RETENTION PERIOD (13.2 a)
Upon completion of the service or the response, your personal data will be retained exclusively for historical or
statistical purposes, in accordance with the law, regulations, EU legislation and the professional codes of ethics and
good conduct signed pursuant to Article 40 of the GDPR for the term required by applicable legislation, or – if not
subject to any law – for a term of no more than five years. Beyond this term, your personal data will either be
retained in an anonymous form or destroyed.

DATA SUBJECTS’ RIGHTS (13.2 b)
In relation to the aforesaid processing, you – the data subject – are entitled to access your personal data and likewise
to request the rectification or erasure of the data and the limitation of the processing concerning your data, and to
object to the processing; you are furthermore entitled to the portability of your data.

RIGHT TO WITHDRAW CONSENT (13.2 c)
If the processing is based on consent, the Data Controller hereby informs you, the data subject, that you are entitled
to withdraw your consent at any time without prejudice to the lawfulness of the processing based on the consent
given prior to withdrawal.

RIGHT TO FILE A COMPLAINT (13.2 d)
The Data Controller hereby informs you, the data subject, that you are entitled to file a complaint with a
supervisory authority, in which case you must use one of the aforesaid means of contact to seek information
therefrom.

COMPULSORY OR VOLUNTARY NATURE OF THE PROVISION OF DATA (13.2 e)
The provision of data and the processing thereof are compulsory when relating to tax requirements. It follows that
refusal to provide data for these purposes may make it impossible for the Data Controller to fulfil the said
professional relationships and meet legal requirements. In the other cases, the provision of data and the processing
thereof should be deemed optional and devoid of consequence.

EXISTENCE OF AN AUTOMATED DECISION-MAKING PROCESS (13.2 f)
The Data Controller hereby advises you, the Data Subject, that there is no decision-making process in place on this
site and therefore, in particular, there is no profiling system in place.

SOCIAL NETWORKS
This site contains links to the following social media sites: Facebook, Google Plus, LinkedIn, and Instagram. The
cookies set by these social networks can be declined by following the procedure stated on each site. Therefore, use
of this site without declining the said cookies implies the user’s consent to the processing of their data by these
social network sites (in relation solely to the aforesaid methods and purposes).
